Terms and Conditions of Booking 1) The Booking party warrants that he/she is either the owner or the authorized agent of the Owners of the Goods, and that he is authorized to accept these conditions not only for himself but also as agent for and on behalf of the Owner. The Booking party confirms that he/she is jointly and severally liable for the acts of his customer and which may be due to mis-declaration of cargo, improper loading and lashing of cargo, etc. 2) The Booking party / Shipper must inspect the empty containers prior to being picked up from the Yard to confirm that they are clean, sound and in seaworthy condition. Costs for any subsequent rejection will be to the Shipper/Booking party’s account together with any claims for damage to cargo due to the failure to inspect the container prior to pick up. 3) Loaded containers must be returned in safe and sound condition at our nominated site within stipulated free time (7 days), failing which detention/advancement fee will be assessed and charged as per our prevailing Tariff. 4) Any Loss and/or damage to the container whilst in custody of Shipper, Transporter, Forwarder/CHA shall be fully recovered from the Shipper, Transporter, Freight forwarder/CHA as the case may be. The Booking party confirms that they are jointly and severally liable for these costs. 5) Original B/Ls must be collected from our office within 7 (seven) calendar days after vessels departure from the port. A delayed document surcharge (DDS)n as per company’s slab will be levied thereafter. DDS must be paid prior to release of the OBL. 6) Ensure that the cargo weight in the container does not exceed the maximum permissible loadability as stipulated on the CSC Plate. In the event of container being overloaded and the gross container weight exceeds permissible limit, all consequential fines and charges incurred for shifting and re- stuffing will be to the account of shipper including any loss or damage arising due to the excessive loading of cargo in the container. 7) Ensure to submit the custom passed Shipping Bill to our operations for loading the container on board the nominated vessel failing which all additional costs arising due to the delays will be on account of the shipper/forwarder/CHA. Same would be assessed and collected prior to release of the Bill of Lading. 8) This Booking confirmation / CDO is Valid for the below specified days. Unless used within those specified days or revalidated, the Booking will lapse/ cancelled. For further extension please contact our Booking Desk. 9) Please submit your SI within 48 hours prior to the vessel arrival at loading port to avoid incurring late fees as per tariff. 10) Please Note without Shipper/Consignee/Notify Party full style address and Tel /Fax No. B/L will not be updated. Hence Please ensure to forward the SI through MAXICON WEB SITE (www.maxiconline.com) with these mandatory details for smoothly process the Bill of Lading. 11) Please ensure that the Shipping Bill (S/Bill) copies are brought at the time of releasing the Original B/ L by your representative. Fax copies are not acceptable. Shipper Declaration The Shipper/Booking Party declares and undertakes that • The cargo and contents are correctly declared • Commit to stuffing your cargo safely in the containers • Are aware that the carrier might open and inspect the laden containers These declarations do not add anything to what is already specified in the terms for carriage and under law. Both the booking party and the shipper have a duty and responsibility to correctly declare, load and lash the cargo inside the container for the intended voyage and therefore we kindly ask for your co-operation. Bookings declared as non-DG: Without prejudice to all the Carrier’s rights under the terms for carriage, confirmation from Shipper (or on behalf of and with full authority from the Shipper) that: • The Goods in this booking are NOT classified as Dangerous Goods as defined and/or classified in the International Maritime Dangerous Goods Code 2016 including any amendments thereto and as may be updated from time to time. • The Goods are safe for carriage by sea and packed and loaded in accordance with the Code of Practice for Packing of Cargo Transport Units 2014 including any amendments thereto and as may be updated from time to time. • Understand that the Carrier is entitled to open and/or scan any package or Container at any time and to inspect the contents. • Bookings declared as DANGEROUS GOODS Without prejudice to all the Carrier’s rights under the terms for carriage, confirmation from Shipper (or on behalf of and with full authority from the Shipper) that: •The Goods in this booking are declared correctly in accordance with the requirements, definitions and/or classifications in the International Maritime Dangerous Goods Code 2016 including any amendments thereto and as may be updated from time to time. • The Goods are safe for carriage by sea and packed and loaded in accordance with the Code of Practice for Packing of Cargo Transport Units 2014 including any amendments thereto and as may be updated from time to time. •Understand that the Carrier is entitled to open and/or scan any package or Container at any time and to inspect the contents.
